1. ACCEPTANCE OF TERMS

By purchasing, downloading, activating, or using our eSIM products and services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use our Services.

2. DEFINITIONS

• "eSIM" means an embedded SIM card that allows you to activate a cellular plan without using a physical SIM card.
• "Service" means the eSIM data plans, connectivity services, and related products provided by us.
• "User" or "You" means any individual or entity that purchases or uses our Services.
• "Device" means any eSIM-compatible mobile device, including smartphones, tablets, or smartwatches.

3. ELIGIBILITY

You must be at least 18 years of age to purchase and use our Services. By using our Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. DEVICE COMPATIBILITY

Our Services require an eSIM-compatible device. You are responsible for ensuring that:

• Your device supports eSIM technology
• Your device must be unlocked and not restricted to a specific carrier. Carrier-locked devices cannot use eSIM services regardless of eSIM hardware support. Contact your carrier to unlock your device before purchasing.
• Your device meets all technical requirements for eSIM activation
• You have an active internet connection for initial setup
• Samsung Galaxy "FE" (Fan Edition) models are not compatible with our eSIM services

We are not responsible for any incompatibility issues with your device. No refunds will be issued for purchases made on incompatible or locked devices.

5. PURCHASE AND PAYMENT

5.1 Pricing

All prices are displayed in the currency indicated at the time of purchase. We reserve the right to modify pricing at any time without prior notice. Price changes will not affect purchases already completed.

5.2 Payment Methods

We accept various payment methods as displayed on our platform. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge all fees incurred.

5.3 Taxes

Prices may not include applicable taxes, duties, or fees. You are responsible for paying all such charges imposed by governmental authorities.

6. SERVICE ACTIVATION AND USAGE

6.1 Activation

Upon successful purchase, you will receive a QR code and manual activation code to install the eSIM profile on your device. Each eSIM can only be installed on one device - the QR code is single-use and cannot be transferred or reused if the eSIM is deleted. The validity period of your plan begins upon first network connection in your destination country, not upon purchase or installation.

6.2 Data Usage

Each plan includes a specified amount of data, validity period, and coverage area. You agree that:

• Data allowances are for personal, non-commercial use only
• Unused data does not roll over after plan expiration
• For unlimited plans, speeds may be temporarily reduced after exceeding the daily high-speed data allowance as specified in the plan details at the time of purchase. Speed reductions reset within 24 hours.
• Services may be suspended or terminated for misuse or violation of these Terms
• We reserve the right to throttle, suspend, or terminate Services if usage patterns materially deviate from typical consumer usage, indicate abuse, or negatively impact network performance, including excessive tethering or automated usage
• Services are intended for short-term travel and tourism use (up to 180 days maximum) and may not be used as a permanent cellular service replacement

6.3 Coverage Limitations

Coverage is provided through partner networks and is subject to network availability. We do not guarantee uninterrupted service, specific coverage areas, or connection speeds. Service quality may vary based on location, network congestion, and other factors beyond our control.

6.4 Reseller Relationship

Roamy Hub is a reseller of eSIM connectivity services and does not own, operate, or control any cellular networks. Mobile connectivity, coverage, speed, latency, and service availability are provided by third-party mobile network operators and are subject to their technical capabilities, network conditions, and policies. Roamy Hub does not guarantee uninterrupted service, specific data speeds, or network performance.

7. PROHIBITED USES

You agree not to use our Services for:

• Illegal activities or purposes that violate any applicable laws
• Commercial resale or redistribution of Services
• Excessive or abusive usage that degrades network performance
• Circumventing technical limitations or security measures
• Sending spam, malware, or engaging in fraudulent activities
• Using automated systems to access or scrape our platform
• Sharing eSIM profiles or activation codes with others

8. REFUND AND CANCELLATION POLICY

Refunds are available within 7 days of purchase if the eSIM has not been activated and zero data has been consumed. Once any data usage occurs, regardless of amount, the purchase becomes final and non-refundable.

9. PRIVACY AND DATA PROTECTION

We collect and process personal information in accordance with our Privacy Policy. By using our Services, you consent to such collection and processing. We implement appropriate security measures to protect your data but cannot guarantee absolute security.

10. INTELLECTUAL PROPERTY

All content, trademarks, logos, and intellectual property related to our Services remain our exclusive property. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal purposes only. You may not reproduce, distribute, modify, or create derivative works without our written permission.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

12. WARRANTY DISCLAIMER

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate your access to Services at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Excessive or abusive use of Services
• Non-payment or payment disputes

Upon termination, your right to use the Services immediately ceases. No refunds will be provided for terminated accounts.

14. CUSTOMER SUPPORT

Customer support is available by chatting with Roamy or by emailing support@roamyhub.com. We strive to respond to inquiries in a timely manner but do not guarantee specific response times. Support is provided in English and may be available in other languages at our discretion.

15. FORCE MAJEURE

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless our company, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of Services, violation of these Terms, or infringement of any rights of another party.

17. DISPUTE RESOLUTION

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict-of-law principles.

17.2 Arbitration

Any dispute arising from these Terms or your use of Services shall be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be conducted in accordance with the rules of a mutually agreed-upon arbitration organization.

17.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.

18. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website or through other communication channels. Your continued use of Services after such modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

19. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

20. EXPORT CONTROL AND SANCTIONS COMPLIANCE

You may not use the Services in violation of U.S. export control laws, economic sanctions, or applicable telecommunications regulations. Use of the Services is prohibited in countries or regions subject to U.S. government embargoes or sanctions. Roamy Hub reserves the right to restrict or terminate Services where required by law or carrier policy.

21. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and us concerning your use of the Services and supersede all prior agreements and understandings, whether written or oral.
